SECTION I. PRIVACY POLICY STATEMENT Fair Trade Outsourcing Ph., Inc. is committed to protecting your privacy and ensure that your personal and sensitive personal information is processed in accordance with Republic Act No. 10173 or the Data Privacy Act (DPA) of 2012, its Implementing Rules and Regulations (IRR) and National Privacy Commission (NPC) Circulars. All personal information that is entered, recorded, and submitted will be collected, used, processed, retained, shared, and disposed of with due regard to the rights of the data subject. All personal information and sensitive personal information obtained herein by Fair Trade Outsourcing shall be kept strictly confidential. Strict adherence to policies are employed to ensure that personal and sensitive data are processed only by authorized personnel and according to organizational privacy measures. SECTION II. DATA SUBJECT RIGHTS Fair Trade Outsourcing Ph., Inc upholds the rights of the data subject and adheres to the general data privacy principles of Transparency, Legitimate Purpose and Proportionality as provided in Republic Act No. 10173 or the Data Privacy Act (DPA) of 2012 and its Implementing Rules and Regulations (IRR). Anent to the data privacy principles, the Data Privacy Act, also provides the following rights, to wit: (a) the right to withdraw the consent hereby given or to object to the processing of personal information provided there is no other legal ground or overriding legitimate interest for the processing thereof; (b) right to reasonable access; (c) right to rectification and (d) right to erasure or blocking of the personal information. Any of the rights aforementioned, particularly the right to withdraw consent, may be exercised by the data subject/signatory at any time after the date of this consent form. SECTION III. COLLECTION OF INFORMATION, USAGE AND RETENTION Fair Trade Outsourcing Ph., Inc. through its various company units and offices, collects and processes any personal and/or sensitive personal information which is/are necessary and related to the fulfillment of duties and functions of the data subject as an employee of the company. The company strictly prohibits the use and disclosure of any identifiable personal information to any third-party without the consent of the data subject involved. SECTION IV. TERMS AND CONDITIONS 1. Sufficient information shall be provided to the signatory as to the types of data collected, the recipients or processing units, purpose of processing, and results of the data analysis. The signatory shall be deemed informed of the nature of the processing of his/her data and apprised of the risks and safeguards involved, upon signing of this form;
2. Fair Trade Outsourcing Ph, Inc. may access the signatory's personal information and sensitive personal information necessary for the compliance with mandatory government regulatory reporting, payment of benefits, and other processes. Similarly, the company has the right to collect any necessary personal or sensitive personal information pertaining to the signatory's medical records and/or billings or statements with the Health Maintenance Organization (HMO), insurance companies, financial institutions, respectively, and other analogous to the foregoing necessary for record verification procedures by the company;
3. Fair Trade Outsourcing, Ph. Inc. may retain the data subject's information for a period of three (3) years or upon the completion of the purposes stated above or at such time that the signatory submits to Fair Trade Outsourcing Ph, Inc. a written cancellation of this consent, whichever is earlier. The signatory agrees that his/her information will be deleted/destroyed after this period; and
4. The signatory may request the rectification of their data where there are incorrect, inaccurate or incomplete personal information or sensitive personal information collected. SECTION V. DATA SECURITY Fair Trade Outsourcing Ph., Inc. strictly implements organizational, physical and technical security measures for the protection of personal information. All personal and sensitive personal information collected are encrypted, the physical access to the hardcopy versions of the information provided are restricted, and measures are in place to ensure that all personal data are processed only by authorized personnel. SECTION VI. DISPOSAL All personal information are destroyed and/or disposed in accordance with the internal policies and procedures set by Fair Trade Outsourcing Ph., Inc. in compliance with the provisions of Republic Act No. 10173 or the Data Privacy Act (DPA) of 2012, its Implementing Rules and Regulations (IRR) and National Privacy Commission (NPC) Circulars on the proper disposal of personal data.
